There is a ruling, but who actually wins: we expose the schemes of a pharma giant and move on
The Commercial Court of the Kharkiv region issued rulings in cases No.922/1423/26 and No.922/1752/26, which obliged the NGO “NON-STOP UKRAINE” to remove publications about the activities of the “Apteka 9-1-1” chain and to retract the information that had been spread. ✅Well, we respect the law and the court’s decision, therefore:
🔻we are removing the publications that displeased the other party so much
🔻we officially retract the information that was contained in those posts, including on our Facebook page.
🔻we publish the full rulings in the specified cases. You can additionally review them at this and this link.
But a warning right away: the attempt to legally block the work of our organization turned out to be another waste of money for the opponents.
The structures of “Apteka 9-1-1”, affiliated with the family of Ashot #Данієлян and Nune Danielyan, tried through the courts not only to remove materials but also to declare our official complaints and statements to state bodies false. The beneficiaries’ lawyers persuaded their clients to seek the maximum claims in order to extract millions of hryvnias from us.
🤷♂️However, the court result proved to be much more modest — about 40 thousand hryvnias in compensation were awarded, which moreover are practically impossible to recover, since the NGO “NON-STOP UKRAINE” is a volunteer organization without bank accounts or commercial assets.
The only real winners in this situation were probably the plaintiffs’ lawyers, who drained tens of thousands of dollars from the pharma business on knowingly hopeless cases.
While the beneficiaries were spending money on lawsuits, we compiled another large body of evidence about the operation of the entire network. We established that an organized group led by the network’s beneficiaries “Apteka 9-1-1” built a scheme of artificial business fragmentation through dozens of controlled legal entities with the same address and management, which allows them to avoid antimonopoly control, hide real profits, and use a shared commercial infrastructure with possible violations of settlements through POS/registration devices.
The network’s financial activity is accompanied by funds being siphoned off and tax underreporting. By signing deliberately false licensing agreements with a foreign company, more than 💰2 billion hryvnias were transferred to the accounts of controlled structures under the guise of royalties.
Commercial operations show violations of licensing conditions and competition rules: lack of a proper quality system, failure to maintain required storage temperature conditions for medicines, and the use of misleading advertising “Wholesale Price Pharmacy.”
Incidentally, based on our complaints, the Antimonopoly Committee of Ukraine opened a case regarding the network’s anti-competitive coordinated actions and the dissemination of the misleading “Wholesale Price Pharmacy” advertising.
Overall, based on our materials, law enforcement and regulatory bodies registered a series of criminal proceedings in the Unified Register of Pre-Trial Investigations, and courts issued a number of rulings regarding officials’ inaction.

Attempts to stop human rights activity through lawsuits only add system to our work. We continue to monitor the pharmaceutical market, file new complaints, and prepare appeals against the first-instance decisions.
