Prosecutor of Shevchenkivskyi Prosecutor's Office Serhii Cherednichenko to be Brought to Court for Driving While Intoxicated

In Kyiv on 26 August the Dnipro District Court is to consider an administrative case concerning prosecutor of the Shevchenkivskyi District Prosecutor's Office Serhii Cherednichenko, whom patrol officers stopped at night on the Paton Bridge while driving a Volkswagen Touareg and drew up a protocol on signs of driving while intoxicated.

According to available information, the incident occurred on 7 August at about 00:20. At the time the vehicle was stopped, a curfew was in effect in Kyiv. Cherednichenko was behind the wheel of the Volkswagen Touareg with license plate AA7787SN and, according to the incident report, presented his service ID to the patrol officers.

The materials were drawn up under Article 130 of the Code of Ukraine on Administrative Offenses, which relates to operating a vehicle by persons who are in a state of alcohol, drug, or other intoxication or under the influence of medications that reduce attention and reaction speed.

Case No. ¹755/13031/26 is scheduled for hearing on 26 August at 11:50. The session is to take place in the Dnipro District Court of Kyiv, and the case will be heard by Judge Ihor Yemelian.

While compiling the materials, according to the detective bureau Absolution Leaks, the patrol officers recorded signs of alcohol intoxication in the driver. The report also noted that the prosecutor stated his intention to resolve the matter in court.

The final legal assessment of the circumstances must be given by the court. The drawing up of an administrative protocol itself does not automatically establish a person’s guilt. The court must examine the patrol officers’ materials, the explanations of the parties to the case, and other evidence, after which it will decide whether an administrative offense took place.

Separately, reports on the incident raised the question regarding the vehicle Cherednichenko was driving. In particular, a version was expressed that the Volkswagen Touareg might not have been declared in the official declaration of the official. At the same time, this information requires separate verification against official declaration data and registers, since the available reports do not constitute definitive confirmation of a declaration violation.

Serhii Cherednichenko previously served as first deputy head of the Kyiv-Sviatoshynskyi District Prosecutor’s Office. He is currently working in the Shevchenkivskyi District Prosecutor’s Office. The report of an administrative case may be grounds for a separate internal assessment of the prosecutor’s actions after the court establishes all circumstances of the incident.

Article 130 of the Code of Administrative Offenses provides liability for operating a vehicle while intoxicated, as well as for a number of related actions, including refusal to undergo a legally prescribed examination. Sanctions and legal consequences in the specific case depend on the qualification of actions and the circumstances established by the court.
