Dniprovskyi authority "Som" remanded without the right to bail

On Saturday, 5 November 2022, the court in Kryvyi Rih granted law enforcement’s request to unconditionally remand 8 individuals, whom the investigation considers participants in a criminal organization that allegedly seized the industrial enterprise PMTZ "Agro-komplekt" by raiding.

This was reported by the Dnipropetrovsk Regional Prosecutor’s Office.

Specifically, the accusations from law enforcement concern the president of the National Federation of Mixed Martial Arts, a long-time partner and "right hand" of the authoritative head of the regional Judo Federation Mykhailo Koshlyak — 49-year-old Serhiy Samoylenko, nicknamed "Som," and a deputy of the Dnipropetrovsk City Council of the 6 convocation, lawyer Andriy Biriuk.

Earlier, on the pages of Detective-Info it was reported that on 3 November 2022, respected figures and several other persons were "packed up" on suspicions of creating an organized criminal group (Part 1 of Art. 255 of the Criminal Code of Ukraine), whose members allegedly fraudulently (Part 4 of Art. 190 of the Criminal Code of Ukraine) seized corporate rights and the property complex of the enterprise PMTZ "Agro-komplekt," and subsequently attempted to "launder" the proceeds obtained in this way (Part 3 of Art. 209 of the Criminal Code of Ukraine).

On 4 November, the Department of Strategic Investigations of the National Police and the Dnipropetrovsk Prosecutor’s Office specified the current charges against "Som" and Co. According to the authorities’ final interpretation, a total of 8 suspects were detained in the scheme, during which, allegedly on the basis of forged documents, members of the OCG introduced a close relative into the list of founders of "Agro-komplekt," "which made it possible to illegally take over the LLC’s corporate rights and subsequently re-register the property’s ownership in a 'their' person." It is believed that these actions caused the victims losses of approximately 16 million UAH.

Note that choosing preventive measures for Samoylenko, Biriuk, and other case figures was delayed by almost a day. "The process of choosing preventive measures was turned into a 'comedy' by the raiders' lawyers. Shouting, screams, recusals of judges, delaying the process to disrupt consideration of motions within reasonable time frames, to give the raiders the opportunity to get out on the loose and continue their 'professional path'," commented head of the DSI Andriy Rubel on the relevant court battles.

Nevertheless, the servants of Themis ultimately accepted the prosecution’s arguments, ordering all eight suspects in the scandalous case to be placed in pretrial detention. Court registry materials show: the investigation of the circumstances of the seizure of PMTZ "Agro-komplekt" property has been carried out by law enforcement since the end of summer 2020. According to the investigation’s version, the raiding "was closely accompanied by questionable registration and notarial actions, in particular through repeated transfer of the charter fund from one person to another, placing property as collateral, changing directors, company names, etc.".
