The Kolomoisky Case and PrivatBank Top Managers Will Not Be Transferred from the High Anti-Corruption Court: Court Denied Defense’s Request

The appellate chamber of the High Anti-Corruption Court did not grant the defense's request to transfer the criminal proceeding concerning Ihor Kolomoyskyi and the former top managers of PrivatBank to another court.

This was reported by the press service of the Appellate Chamber of the HACC.

28 August 2026 year, a panel of judges examined the defense's petition to send the case from the HACC to another court. As a result of the review, the court denied satisfaction of the petition.

The decision entered into force immediately after its announcement. It cannot be challenged in cassation.

The case concerns criminal proceedings No. 991/10098/26 regarding the former ultimate owner of PrivatBank Ihor Kolomoyskyi and the ex-top managers of the financial institution.

According to investigators, the defendants are charged with misappropriation of property on a particularly large scale by an organized group, legalization of proceeds obtained by crime, and official forgery. The actions of the suspects are qualified under part 5 of Art. 191, part 3 of Art. 27, part 3 of Art. 28, part 1 of Art. 366, and part 3 of Art. 209 of the Criminal Code of Ukraine.

Besides Kolomoyskyi, the defendants include the former chairman of PrivatBank Oleksandr Dubilet, his deputy Liudmyla Shmalchenko, the head of the interbank operations department Nadiia Konopkina, the head of the interbank dealing department Yaroslav Luhovyi, and the deputy head of the department for servicing correspondent banks’ accounts Tetiana Yakymenko.

According to the investigation, the scheme for misappropriating funds was organized in 2015 year, when Kolomoyskyi owned PrivatBank.

At that time, the bank allegedly was forced to pay the controlled company more than 9,2 billion UAH under the pretext of a reverse repurchase of its own bonds at an inflated price.

Another over 446 million UAH, according to the investigation, was laundered through operations with securities of related companies.

Attempts to have the case considered against Kolomoyskyi in another court had already occurred. In particular, former PrivatBank chairman Oleksandr Dubilet previously attempted to transfer another case of bank funds embezzlement from the HACC to the Zhytomyr District Court of Dnipropetrovsk, which is now called the Sobornyi District Court of Dnipro.

The Supreme Court then rejected such arguments, noting that the issue of jurisdiction had already been decided in October 2023 year and cannot be reviewed again.
