The case of Kolomoisky and PrivatBank executives will not be transferred from the High Anti-Corruption Court: the court denied the defense's motion

The appellate chamber of the High Anti-Corruption Court did not grant the defense's motion to transfer the criminal proceedings regarding Ihor Kolomoyskyi and the former top managers of PrivatBank to another court.

This was reported by the press service of the Appellate Chamber of the HACC.

28 August 2026, year, the panel of judges considered the defense’s motion to transfer the case from the HACC to another court. As a result of the review, the court denied satisfaction of it.

The decision took legal effect immediately after its proclamation. It cannot be appealed cassationly.

This concerns criminal proceedings No. ¹991/10098/26 against former ultimate owner of PrivatBank Ihor Kolomoyskyi and former top managers of the financial institution.

According to the investigation, the accused are charged with misappropriation of property on a particularly large scale by an organized group, legalization of property obtained by criminal means, as well as official forgery. The acts of the defendants are qualified under part 5 of art. 191, part 3 of art. 27, part 3 of art. 28, part 1 of art. 366 and part 3 of art. 209 of the Criminal Code of Ukraine.

In addition to Kolomoyskyi, the defendants include the former chairman of PrivatBank Oleksandr Dubilet, his deputy Liudmyla Shmalchenko, head of the Interbank Operations Department Nadiia Konopkina, head of the Interbank Dealing Department Yaroslav Luhovyi, and the deputy head of the department for servicing accounts of correspondent banks Tukthiana Yakymenko.

According to the investigation, the scheme to misappropriate funds was organized in 2015, when Kolomoyskyi was the owner of PrivatBank.

At that time the bank, according to the investigation, artificially obliged to pay the controlled company more than 9,2 billion UAH under the pretext of repurchase of its own bonds at an inflated price.

Another more than 446 million UAH, according to the investigation, were laundered via operations with securities of related companies.

Attempts to have the cases against Kolomoyskyi heard in another court had already taken place. In particular, the former chairman of PrivatBank Oleksandr Dubilet previously tried to transfer another case of misappropriation of bank funds from the HACC to the Zhovtnevyi District Court of Dnipropetrovsk, which is now called the Sobornyi District Court of Dnipro.

Then the Supreme Court rejected such arguments, noting that the issue of jurisdiction had already been decided in October 2023 and cannot be reviewed again.
