Anton Yatsenko: father-in-law's estate in Kozyn received a "private" shore and blocked people's path

In Kozyne, Kyiv region, near a estate exceeding 1500 square meters, registered to the father-in-law of MP Anton Yatsenko, part of the Kozachka river shore has been fenced off. From land, access to the water is practically impossible. Now environmental authorities must check on what grounds the area near the water was effectively made inaccessible to bystanders.

This is not just about a fence around private territory. If a fence blocks access to a coastal plot that belongs to a coastal protection belt, the question arises whether such a decision complies with the law. The Land Code provides for unhindered and free access of citizens to river and water body shores for general water use, unless lawfully established exceptions exist, media outlets write. The Water Code explicitly prohibits restricting citizens' access to the shores of water bodies by erecting fences and other structures within coastal protection strips. Therefore, the final answer should be given not by the owner of the adjacent property, but by an inspection of the land status of the territory, its boundaries, and the legality of the installed fence. This story attracts particular attention because of the scale of the object. The house in Kozyne, registered to Ivan Kravchuk, Yatsenko’s father-in-law, has an area of over 1500 square meters. Now the question of the origin and structure of this property is complemented by another question: has the actual use of private territory extended to space that by law must remain accessible to the public. The situation effectively looks like this: a large estate sits near the water, the shore nearby is fenced off, and for an outsider it is almost impossible to reach Kozachka from the land. It is this legality of such restriction that should become the subject of review. So far there is no final state authority conclusion that the fence was erected illegally.

Nearby the estate is the Dynasty complex, which is already mentioned in the NABU and SAP joint investigation into elite development in Kozyne. According to investigators, the case concerns the legalization of more than 460 million hryvnias through the construction of private residences. At the same time there is no data linking Anton Yatsenko or his father-in-law to this case, and the proximity of objects does not indicate a connection between them. In the Dynasty case, anti-corruption authorities reported seven suspects and construction of four private residences with auxiliary buildings. The land mass of the complex was about 8 hectares, and construction of one of the residences, according to investigators, was valued at approximately 2 million dollars. A separate line is the real estate of the Yatsenko family. According to preliminary estimates, this involves 78 objects, with a total indicative value of about 1 billion hryvnias. This is a preliminary assessment, not an officially established value of assets by the state. At the same time, such a quantity of real estate makes questions about its origin, registration, and actual use a matter of public interest. The key question for controlling bodies is whether the Kozachka shore near the estate has the same legal status as other plots within the coastal belt, and who and on what grounds authorized access restrictions. If violations are established, authorities may require removing barriers to water access and take other legally prescribed measures.
