Permanent disability: under what conditions the status can be reviewed and what to do if summoned

However, as attorney Oleh Yakymenko notes, in certain cases such decisions may be reviewed by supervisory bodies or by new expert teams. A re-examination is not a routine planned check, but it should not be ignored, because the mere fact that the procedure has begun does not automatically mean losing disability.

Why the system is changing and whether this affects permanent disability status

Since January 1 of 2025, Ukraine has a new procedure for establishing disability for adults: instead of the former MSEK (medical-sociological expert commissions) evaluating a person’s functioning, special expert teams conduct the assessment (in accordance with Cabinet of Ministers resolution No. 1338).

At the same time, moving to the new system does not automatically cancel previously granted permanent disability. If your MSEK certificate or the excerpt from the decision states “permanent” (or there is no term for a re-examination), you are not obliged to rush to a re-examination merely because of changes in institutions’ names or rules of operation.

When a permanent status can still be reviewed

The absence of planned examinations does not exclude the possibility of reviewing the justification of the previous decision. Resolution No. 1338 provides clear grounds for revising the conclusions of former MSEKs or new teams:

The presence of official procedural decisions from a investigator, prosecutor, or court (for example, within criminal proceedings regarding possible abuses).

Conducting checks within the framework of special state monitoring mechanisms.

In such cases, the examination focuses not so much on the current health status but on the legality and medical basis of the initial establishment of disability.
