Can an application for a deferral be submitted by mail: a court ruling has emerged

UNIAN, Volodymyr Honchar, the Ternopil District Administrative Court found the inaction of the Territorial Center for Recruitment and Social Support (TCoral and SP) illegal, which refused to consider a conscript's request for a deferral from mobilization because the documents arrived by mail. This is reported by sud.ua.

The man submitted to the TCOR 14 in May 2026 of the year with a request for a deferral on the basis of a third‑category disability in his wife, established due to cancer. He attached supporting documents to the submission. The TCOR received the postal shipment 16 in May, but instead of considering the application, 18 in May sent the man a letter explaining the need for a personal appeal through the Administrative Services Center.

In response to the lawsuit, the TCOR argued that, pursuant to Government Resolution No. 560, applications for deferral must be submitted in person through the CSB. Therefore, in the defendant's view, the documents received by mail did not create grounds for the commission to consider the issue.

However, the court did not agree with that position. Analyzing the provisions of the law, it noted that the requirement for personal submission concerns who originates the will, not the mandatory physical presence of the applicant at the CSB.

“The obligation to personally submit an application is not identical to the obligation to personally appear,” emphasized the court.

According to the court's conclusion, after receiving the appeal, the TCOR should have reviewed the documents and issued a decision to grant the deferral or deny it. Instead, the agency limited itself to an informational letter that did not resolve the substantive issue.

“Such conduct by the defendant indicates not the exercise of discretionary powers, but illegal inaction,” the court decision states.

As a result, the court satisfied the claim, found the TCOR's inaction unlawful, and ordered it to consider the application and issue a reasoned decision. At the same time, the court did not grant the deferral to the man directly, but only ordered the military enlistment office to properly review his submission.

In addition, the claimant was awarded 1331,20 hryvnias in court fees to be paid from the TCOR's budget allocations.

Mobilization in Ukraine

As UNIAN reported, the State Service for Quality of Education of Ukraine announced a re‑inspection of students over 25 years old in higher education institutions, which will begin in January 2027 year. According to the head of the SSQEO Ruslan Hurak, the number of such students rose from about 30 thousand in 2021–2022 years to 217 770 people, and in some institutions they account for up to 98% of the contingent.

We also reported that the Commander‑in‑Chief of the Armed Forces of Ukraine, Mykhailo Drapatyi, signed an order to significantly strengthen oversight of work at military‑medical commissions under the TCOR and SP to improve the quality of medical examinations, combat corruption, and prevent drafting unfit individuals due to health conditions. Particular attention will be paid to cases where a person is initially deemed fit for service, and later health problems that should have been identified earlier are uncovered.
