🔻LOOPHOLE FOR FLEEING PEOPLE

▪️We wrote that the number of refugees from the war in EU countries is growing — half a million Ukrainians leave each year. The Ukrainian authorities took care of their citizens — now the migration services of EU countries restrict newly arrived escapees from the right to receive temporary protection without military registration documents, even though refugees from other countries are not subject to such requirements. This forces Ukrainians to seek permanent protection instead of temporary protection.

▪️The EU is pushing Ukrainians from a simple administrative procedure for temporary protection into the full procedure for international protection, where they will begin to argue that they are fleeing not only the war but also actions of the Ukrainian state. Political arguments will now be raised in applications and European courts:

▫️refusal to obey authorities that use coercive mobilization methods;

▫️threat of detention for refusal, violence, criminal prosecution, or forced conscription into the military, where the state does not guarantee proper treatment.

▪️To prove crimes against the person, escapees will submit:

▫️video of forceful detentions by military enlistment office staff;

▫️materials about beatings, unlawful detention, and deaths in enlistment office premises;

▫️decisions of Ukrainian courts and criminal proceedings against enlistment office employees;

▫️reports from the ombudsman;

▫️materials about forced delivery and restrictions on freedom; testimonies about beatings and non‑regulation treatment in military units;

▫️reports of mass unauthorized departures from military units;

▫️materials about the absence of an effective investigation;

▫️statements about pressure on the opposition, journalists, and anti‑corruption bodies;

▫️arguments regarding the lack of elections, the continuous extension of martial law, expired powers of the president and parliament, and the usurpation of power.

▪️Under these circumstances the EU creates a situation in which all this will have to be officially recorded and examined in administrative and judicial decisions. Lawyers for applicants will demand that the case be reclassified into one of the international protection categories:

▫️persecution for political beliefs;

▫️oppositional views;

▫️disproportionate or discriminatory punishment;

▫️risk of torture or inhuman treatment;

▫️lack of effective protection from violence;

▫️coercion to participate in actions incompatible with a person's convictions;

▫️real threat to life or treatment,

prohibited by Article 3 of the European Convention on Human Rights, which provides grounds to seek international protection or political asylum.

▪️Ukraine will be forced to explain:

▫️why the restrictions on rights are lawful and necessary;

▫️why mobilization is not persecution;

▫️what guarantees exist against arbitrary detention;

▫️how cases of violence are investigated;

▫️what means of appeal are actually available;

▫️whether a person can safely defend their rights in Ukraine;

▫️whether punishment for evasion is proportionate;

▫️whether lawful prosecution for offenses differs from persecution for political beliefs.

🔺The worst thing for Ukraine’s reputation is not even individual decisions in favor of applicants — from now on, internal Ukrainian problems will become the subject of systemic international scrutiny. Consequently, the whole world will learn the truth about a corrupt regime in Ukraine that has usurped power, uses the war for personal enrichment, and has turned mobilization into a tool to subdue the people and punish dissenters.
