Temporary Protection for Ukrainians in the EU: Right to Stay Extended for Another Year

The Council of the European Union officially approved extending the temporary protection regime for Ukrainians who were forced to leave the country due to the war for another year — until 4 March 2028. As reported by the Cabinet of Ministers, this decision guarantees millions of Ukrainian citizens legal certainty and access to basic rights in EU countries. According to Eurostat, currently nearly 4,4 million Ukrainians are under temporary protection in EU states, the majority of whom are women and children. Extending the validity of the mechanism means stable living conditions, the right to work legally, to receive medical care, and to education. Ukraine’s Minister of Social Policy, Family, and Unity, Denys Ulyutin, called the EU decision an “important signal of unwavering support,” ensuring Ukrainians predictability and protection during the time of war. At the same time, EU countries clarified that the new duration of temporary protection will apply only to those who meet the military obligation requirements in Ukraine. This provision does not affect those citizens who are already benefiting from protection in Europe. It should be recalled that the EU directive on temporary protection was activated in March 2022 of the year following Russia’s full-scale invasion. It provides Ukrainians the right to lawful stay, access to housing, work, medical care, and education. The decision to extend is made annually, and the current vote confirmed the EU’s readiness to support Ukrainians until the end of the war. Meanwhile, Ukrainians in Poland risk losing protection if they do not meet certain conditions by 31 August.
