Embezzling the State of Ukrainians: The High Anti-Corruption Court Allowed In-Absentia Investigation into the Shurma Brothers, Friends of Zelensky

The Appeals Chamber of the High Anti-Corruption Court granted permission to conduct a special pre-trial investigation regarding three individuals accused of abusing the "green" tariff.

This was reported by the court’s press service.

"18 August 2026 year, the Appeals Chamber of the HACC considered the prosecutor’s appeal against the decision of the investigative judge of the HACC dated 28.05.2026 refusing to carry out a special pre-trial investigation concerning the former Deputy Head of the Office of the President, his close relative, and a former official of PJSC Zaporizhzhiaoblenergo."

"As a result of the consideration, the panel of judges of the Appeals Chamber satisfied the prosecutor’s appeal, annulled the investigative judge’s decision of the HACC, and granted the motion to conduct a special pre-trial investigation in relation to the suspects," the statement reads.

It is noted that the decision took effect from the moment it was pronounced and is not subject to appeal in cassation.

According to the Center for Judicial Reform, this concerns former Deputy Head of the Office of the President Rostyslav Shurma and his brother Oleh Shurma.

"According to the investigation, in 2019–2020 years Rostyslav Shurma together with his brother built solar power plants and signed agreements with a state enterprise for the sale of electricity.

After the occupation of part of the Zaporizhzhia region, the solar power plants lost connection with Ukraine’s power system, yet the Shurma firms continued to declare electricity production and received payment for it under the ‘green’ tariff," the Center for Judicial Reform alleges.

Recall: the Cabinet of Ministers prematurely terminated the powers of former Deputy Head of the Office of the President Rostyslav Shurma on the supervisory board of Naftogaz.

President Volodymyr Zelensky 3 September 2024 year dismissed Rostyslav Shurma from the position of Deputy Head of the Office of the President. Shurma held this position since 23 November 2021 year.

21 January 2026 year, NABU and SAP reported that they uncovered a scheme to appropriate funds intended for payments under the "green" tariff, which operated for the benefit of a number of commercial energy-generating enterprises located on the temporarily occupied territory of the Zaporizhzhia region.

During the investigation, law enforcement notified nine individuals of suspicion, among them — the former Deputy Head of the Office of the President and former member of the supervisory board of NJSC Naftogaz of Ukraine, his brother — the owner of a network of Ukrainian and foreign companies, a trusted person of the former high-ranking official, heads and employees of controlled enterprises, as well as the former commercial director of JSC Zaporizhzhiaoblenergo.

In February 2026 year Shurma stated that he is ready to cooperate with the National Anti-Corruption Bureau but is currently in Germany.
