На прикладі витягу поданого щодо земельної ділянки з кадастровим номером 3221888800:38:140:0567 (на якій розміщено ЗТП №1504) можна встановити, що за номером запису йде мова про інше речове право – 34448134 в реєстрі Речових прав на нерухоме майно містяться відомості про право оренди зовсім іншої земельної ділянки, яка розташована на території Запорізької області, Токмацький район, та іншими даними орендаря - Фермерське господарство «БРАТ», код ЄДРПОУ 31260833;

Крім того, реєстраційний номер заяви, за якою було сформовано вказаний витяг, є номером заяви іншої особи щодо іншого об’єкта. В реєстрах нерухомого майна також відсутні будь-які відомості за критерієм пошуку «Реєстраційний номер об’єкта нерухомого майна: 1968459611365», по суті це просто набір випадкових цифр.

Згідно з відкритими даними сайту НАЗК – державний реєстратор Бартко Т.М., працювала державним реєстратором не у КП «ПРІОРИТЕТ», а у Першотравенській сільській раді Обухівського району Київської області, тобто фактично не мала права здійснювати реєстраційні дії.

З інформаційної довідки з Реєстру речових прав на нерухоме майно щодо всіх реєстраційних дій, проведених по відношенню до вказаних земельних ділянок, вбачається, що відносно них ніколи не реєструвалося право оренди, сторонами якого були ТОВ «Б.М.К.-Білдінг» та ТОВ «Рівер Гарден».

Володимир Мікуленко як директор ТОВ «Б.М.К.-Білдінг» ніколи не підписував зазначену Додаткову угоду, його підпис було підроблено, про що свідчить Висновок експертів за результатами проведення судової почеркознавчої експертизи складений КНДІСЕ від 29.07.2021 року за номером №20728/20729/21-32. Мікуленко не був знайомим і ніколи в житті не зустрічався з Куликом В.О., який підписав зазначену Додаткову угоду, свідомо використавши підроблений підпис Мікуленка та свідомо ввів в оману ПрАТ «Київобленерго» про набуття ТОВ «Рівер Гарден» права власності не земельні ділянки ТОВ «Б.М.К.-Білдінг».

Згідно з відкритими реєстраційними даними власниками ТОВ «Рівер Гарден» є громадяни України Грекул Ростислав Володимирович та Караученко Дмитро Георгійович, які не тільки протиправно заволоділи електричною потужністю ТОВ «Б.М.К.-Білдінг», а ще згодом спільно із Кирилом Шевченко та іншими фізичними особами, учасниками злочинної групи, безоплатно набули право власності на 36 га землі, що раніше належала ТОВ «Б.М.К.-Білдінг» та була продана ТОВ «ПРОЗРІННЯ» на законних підставах.

З інтернет джерел відомо, що ТОВ «Рівер Гарден» пропонує до продажу не належні йому земельні ділянки, та які перебувають під арештом за Ухвалою господарського суду по справі 908/1487/21 (908/1624/21) від 08.06.2021 року, право власності на які протиправно набули Кирило Шевченко, Караученко, та родичі Грекула.

На підставі цих фактів Володимир Мікуленко, подав заяву до Господарського суду Дніпропетровської області про відкриття провадження у справі про банкротство. Із заявою до суду він звернувся з метою запобігання протиправної ліквідації Шевченком К.В. компаній ТОВ «Б.М.К.-Білдінг», з метою законного відновлення прав фізичних і юридичних осіб по відношенню до ТОВ «Б.М.К.-Білдінг».

Зрештою, вся ця історія з обкраданням швейцарських інвесторів лише погіршує імідж України, як країни, відкритої для інвестицій. Фігура ж Шевченка і пов’язані з ним скандали також не робить користі нашій країні на міжнародній арені. Адже Кирило Шевченко відомий не тільки рейдерським заволодінням землею, а й багатьма іншими своїми походеньками, при цьому він старається прикритись іменем мера Києва Віталія Кличка, якого тим самим дискредитує. На початку року Шевченко, не дивлячись на всі заборони воєнного стану, виїхав через державний кордон України до Чорногорії.
