У Державному бюро розслідувань знову розслідують кримінальне провадження за фактом можливого заволодіння та розтрати державного майна внаслідок самовільних дій посадових осіб Державного підприємства «Науково-дослідний, виробничий агрокомбінат «Пуща-Водиця» та посадових осіб ТОВ «Столиця Груп».

Йдеться про кримінальне провадження № 12019000000001057, яке було відкрито 12.11.2019 Головним слідчим управлінням Національної поліції України за ч. 2 ст. 364 (зловживання владою або службовим становищем) та ч. 5 ст. 191 КК України (привласнення, розтрата майна або заволодіння ним шляхом зловживання службовим становищем).

За даними слідства, посадові особи групи компаній «Столиця», діючи за попередньою змовою з керівництвом ДП «НДВА «Пуща-Водиця» та посадовими особами Міністерства аграрної політики та продовольства України, з 2008 року реалізують злочинну схему щодо припинення права постійного користування земельними ділянками агрокомбінату на території Подільського району м. Києва площею 286 га.

Нагляд за дотриманням законів під час досудового розслідування у зазначеному провадженні здійснює Офіс Генерального прокурора.

За даними lun.ua, на цих ділянках будуються житловий Варшавський мікрорайон, ЖК «Варшавський Плюс» та ЖК «Варшавський-2» (проекти від Stolitsa Group), ЖК «Крістер Град» (проект від ДСК-Житлобуд), ЖК Dibrova Park (проект від IB Alliance, ділянка 55 га, де побудований цей ЖК, фігурує в документах, злитих з комп’ютера Дениса Комарницького), ЖК «7 Квартал» та ЖК «V Квартал» (проекти від Perfect Group нардепа від ОПЗЖ Дмитра Ісаєнка).

Завдяки рішенню Київради від 10 червня 2021 року, яким було затверджено Детальний план території, стала можливою забудова цієї ділянки новим житловим комплексом. 13 січня цього року КМДА видала вихідні дані на цей ЖК, незважаючи на значний спротив місцевих жителів та обіцянки мера Віталія Кличка не допустити забудову. Інвестором розробки зазначеного ДПТ є ТОВ "Датоліт", що пов’язане зі Stolitsa Group.

Власниками ТОВ "Столиця Груп" (Stolitsa Group) є кіпрська компанія Elakol Developments Limited (89%) та ТОВ "КУА "Бізнес-Гарант", що діє в інтересах інвестфонду "Кроун" (11%). Кінцевими власниками Elakol є громадяни Литви Раймондас Туменас, Агне Рузгієне та Марина Познякова і киянин Іван Молчанов, син Владислави Молчанової – спонсорки партії «Батьківщина». У 2016-2018 рр. Молчанова сама входила до бенефіціарів «Столиця Груп». За даними "Економічної правди", Молчанова продовжує приймати ключові рішення в компанії.

підписали спочатку інвестиційні договори, після чого відмовилися від постійного користування зазначеними ділянками та незаконно відчужували державне майно,

і в подальшому уклали додаткові угоди до інвестиційних договорів, відмовившись від отримання відповідних площ житла та нежитлових приміщень в об’єктах будівництва, в обмін на отримання 4-5% вартості ділянок на момент передачі їх під забудову.

Слідство вказувало, що такий обмін є непропорційним, враховуючи співвідношення вартості зазначених ділянок та оцінки об’єктів станом на момент укладення інвестиційних договорів, вартості житлової та нежитлової забудови, яка триває на зазначених ділянках і на цей час.

Йдеться про інвестиційні договори з ТОВ «Мартин», ТОВ «Конкорд-ДС Плюс», ТОВ «Каштанове місто», ТОВ «Проектінвестстрой», ТОВ «Датоліт», ТОВ «Олівер-Строй», ТОВ «Інтерпроект», ТОВ «Сітібудсервіс».

За даними кримінального провадження № 42016100000000922 від 28.09.2016, яке розслідував слідчий відділ прокуратури м. Києва, внаслідок укладених у 2008-2015 рр. інвестдоговорів держпідприємство недоотримало щонайменше 380 млн грн. Держпідприємство отримало у 2015 році (5% в об’єкті будівництва) і ціною, за якою квартири реалізують забудовники (470 млн грн).

У зв’язку із забудовою земель «Пущі-Водиці» згадувалося також кримінальне провадження № 42020101070000078 від 24.03.2020, розслідуване слідчими Подільського УП ГУ Нацполіції в м. Києві та закрите 23.04.2021.
