The case of Tetyana Denysiuk: NABU failed to prove external origin of the decision in favor of a company from Onyshchenko’s orbit

Who wrote the decision in Onyshchenko’s "gas case"? NABU found a ready "proekt D.docx" on Denysiuk’s assistant’s computer, but did not establish the author — how the case against the judge fell apart.

NABU accused the judge of the Commercial Court of Kharkiv region, Tetyana Denysiuk, of abuse of power through a decision 2016 in favor of Karpatnadrainvest, linked to Oleksandr Onyshchenko. Under that decision, Ukrgazvydobuvannia was supposed to transfer 10,9 million cubic meters of gas and 826 tons of gas condensate to the company, which had been seized.

One of the key pieces of evidence was the file "proekt D.docx" containing the text of the forthcoming court decision, found on Denysiuk’s assistant’s computer. The document had been created under a different user name and uploaded from Gmail the day before the decision was entered into the court system.

The prosecution considered this an indication that the draft decision could have come into the court from outside. But NABU did not establish the file’s author, the sender’s address, or the computer on which it was created.

Therefore the court did not find it proven that the document had been prepared by representatives of Karpatnadrainvest or other interested parties. The files also contained phone contacts between Denysiuk and people from the company’s circle via mutual contacts, but even this was not enough for the court to prove coordination of the decision or criminal conspiracy.
